产品检验及测试可由买方或由买方委托的第三方参与进行。但所有由此检验及测试发生的买方或由买方委托的第三方人员的全部费用应由买方承担。卖方将尽可能地提供工作便利和支持。
The SELLER shall, at least 2 weeks in advance, inform the test schedule to the BUYER prior delivered. The BUYER reserves his right to select whether dispatch his personnel to the SELLER's testing site for witness test.
卖方至少应在出厂试验开始前2周将出厂试验计划书面通知买方，买方有权选择是否派员到卖方试验所在地目睹试验。
10. 性能测试
10.1 Preparation 准备工作
Transport, storage, erection and operation must comply with the Seller’s instructions TRK 3035 supplied together with the column internals.
运输，储存，安装和操作须按照卖方与塔内件一起提供的 TRK 3035 指导手册进行。
When the erection and installation of the column are completed, it must not deviate more than 0.3% from the vertical in operation (measured from top to bottom, flange to flange). If the forces are sustained due to thermal expansion after starting-up, the verticality of the column must be checked while it is at operating temperature.
当塔安装和安装完成时，垂直偏差不应超过0.3％（从顶到底，从法兰到法兰测量）。开车后，如果因热膨胀造成持续力，塔垂直度须在操作温度下再次进行检测。
The packing and internals (collectors, distributors, support grids, locating grids) are fitted at the site. A Seller’s specialist must be called in, to inspect the work carried out according to 3.3.1.b as well. 填料和塔内件（收集器，分布器，支撑格栅，定位格栅等）仅在买方施工现场进行安装。买方须通知卖方的专家监督现场安装指导工作。
The column must be kept clean during erection and reach vacuum tight.
在塔安装时，塔内须保持清洁，且塔在安装完毕后确保达到操作时要求的真空度。
The insulation of the column must meet the requirement. 塔绝热须满足要求。
10.2 Trial run without the presence of the Seller 卖方代表不在场的考核
Should the Buyer be satisfied that the guarantee has been fulfilled, a trial run in the presence of a Seller representative shall not be deemed necessary.
如果买方对已达到的性能感到满意，则不一定需要卖方代表在场情况下的性能考核。
10.3 Trial run with a Seller representative present卖方代表在场的考核
If the presence of a Seller’s representative is required during the trial run, the following conditions have to be fulfilled:

All operating media such as, but no limited to heating, coolants, electricity, and control air and product must be available without cost to the Seller in sufficient and constant quantities and of the suitable quality.
所有操作介质，如，但不仅限于供热，冷却剂，供电，供气及产品，必须足量、稳定、优质地配备。
At least one Seller’s representative will be present at the trial. 在性能考核期间至少有一位卖方代表在场。
The principal operating parameters like pressure, temperature, gas load and product streams must be kept constant, monitored continuously and recorded or logged. The analyses must be made continuously and speedily and must entail no costs for the Seller.
主要操作参数，如压力，温度，气体负荷和产品流量，必须保持稳定、被连续地监测并做记录。分析必须连续地快速地进行，分析结果应免费提供给卖方。
If the measured results call into question the proof of performance, the cause will be investigated as quickly as possible in collaboration with the Buyer. The Seller is entitled to request contesting analyses by a neutral body acceptable to the Buyer. The costs will be borne by the Seller, only if the results show that the objection was not justified.
如果卖方对性能考核的结果产生质疑，则买方应立刻与卖方和工程设计方一起检查此原因。卖方有权要求一个被买方和工程设计方所接受的中立机构进行分析测试。该费用由卖方承担，但如果该机构的测试结果显示原性能考核的结果是错误的，则由买方承担该项费用。
All accessory equipment affecting the column operation (evaporator, condenser, pumps, vacuum installation, control system, etc) must be employed appropriately for the process and must function properly.
所有可能影响塔操作的辅助设备（蒸发器，冷凝器，泵，真空装置，控制系统等）在性能考核过程中必须使用正确且运转正常。
The test run period shall be fixed at a total of 72 hours (excluding traveling time). 性能考核时间为连续72小时（不包括旅途时间）。
10.4 Performance guarantee fulfilled 性能保证完成
Based on design condition, if the values guaranteed are kept stable and constant to the design value during the prescribed time, the guarantee is considered fulfilled. A report is then made of the successful guarantee trial, stating that the performance guarantee has been fulfilled. The report also contains the operating conditions and results noted during the guarantee trial. Further it may include recommendations and suggestions for improvements in future plant operation. The report must be signed by an authorized representative of the Seller and the Buyer.
在设计条件下，如果在考核时间内达到工艺性能保证值，则被认为是已考核合格。然后编写报告说明性能考核成功，工艺性能保证已完成。报告需包括试运转期的操作条件和结果。另外也可以包括对今后装置操作的改进意见和建议。此报告必须由甲卖方的授权代表签字。
The performance trials are to be carried out as soon as possible after erection. If they are not carried out within 12 months of unit starting to work, the performance guarantee will be considered as fulfilled just the same.
在塔安装后，要尽可能早地进行性能测试。如果在本设备所属装置开车后12个月内性能测试还未进
行，则性能考核将被认为已经通过了。

If buyer can not finish performance trial in 12 months of unit starting to work because of force majeure, we should kindly discuss them to reach agreement.
由于不可抗力因素造成买方无法在开车后12个月内进行性能测试，由双方协商解决。
10.5 Performance guarantee not fulfilled 性能保证未完成
The Buyer and the Seller will discuss the possible causes. The Seller will be allowed the necessary time for possible modifications. At the request of the Seller, further trials will be made to ascertain the cause.
如果设计、制造达不到工艺性能保证，双方将努力进行整改。应该允许卖方有必要的时间做可能的改进，并进行进一步的测试以便弄清原因。
Should these trials not be successful due to products quality, the Seller must supply additional packing or other internals till the guaranteed values are met.
如果因卖方产品质量原因造成工艺性能不能达标，卖方应承担相关责任，并将免费提供相应塔内件，直到达到设计要求为止。
Should these trials not be successful, the Seller shall concede as per attached schedule of guarantee penalties.
如果经整改后卖方提供的塔内件仍达不到工艺性能保证值，卖方将按商务合同有关条款承担赔偿责任。

11. Hydraulic Guarantee 水力学性能保证
Column design meets the vapor/liquid turn down requirement of Linde, and also meets the vapor/liquid turn down requirement of Hualu from 50-110%.
保证塔的处理能力满足所附招标文件中专利商Linde数据表的操作弹性，同时满足华陆设计院技术规格书要求的50～110％操作弹性的要求。
Sulzer guarantee column pressure drop can meet Hualu's requirement at 100% loading, and also meets Linde's requirement about Actual Pressure Drop at 110% loading. Detail sees blow and attachment 1.

12. Mechanical Guarantee/机械性能保证
12.1 Any damage occurring to the Equipment in the course of installation, commissioning and
performance test of the UNIT shall be checked by both parties and if such damage is due to SELLER's reasons, such damages shall be remedied at the SELLER’s own expenses in such a way that the Equipment shall be corrected, repaired or replaced by the SELLER.
在安装，试运转和性能考核期间，发生任何设备的损坏，买卖双方应共同检查，而如果这种损坏
是由于卖方原因引起的，则这种损坏应由卖方自费处理，设备由卖方更正，修理或更换。
In case a defect of Equipment is found due to the BUYER’s fault, the BUYER shall correct, repair or replace the Equipment at his own expenses, the SELLER shall be responsible to give his assistance.
如果这种损坏是由于买方的原因，则买方应自费更正，修理或更换此设备，卖方有责任提供协助。
